New Immigration Laws in Sweden

And as of today, several new laws come into force that have

to do with immigration.

One of them is the highly publicized law on good conduct requirements,

meaning, roughly, living respectably.

We are going to go through this now.

Joining us via link is Mikael Kinderboom.

You are a lawyer and editor-in-chief at the legal news agency

Blenda and Lexnova. Good morning to you.

If we start with a law that entered into force yesterday, which means

that permanent residence permits will, as a rule, cease to apply.

What does that mean in practice?

It means that those seeking protection in Sweden, seeking asylum,

they can no longer count on getting clear answers about staying permanently.

Instead, there will be temporary residence permits going forward.

And who is affected by this change?

That is everyone seeking protection,

seeking refugee status or who has refugee status,

subsidiary protection status, or those who have applied based on family ties.

They will not receive

anything other than temporary residence permits.

But does it affect people who already have residence permits in Sweden? No,

that will not...

Rather, those who have permanent residence permits get to keep them.

Today, another new law also comes into force, which entails so-called

good conduct requirements for residence permits.

Good conduct, a word that you might not use every day in colloquial speech.

What does it mean, first and foremost, legally?

This is a legally tricky word.

It is even an old biblical concept, meaning that

conduct is the way of life you have. How you conduct yourself in life.

It has been extremely difficult to find a definition for this concept.

A so-called legal definition.

And in the end, they had to give up on that.

The Migration Agency will have to interpret the meaning of this.

What does that mean, roughly?

It means that you should live respectably. What does respectably mean?

You must not misbehave.

Today, it is basically only through crime that you can lose your

residence permit. But how do they expand that, then?

For example, it could be that you haven't paid fines or

misbehave in other ways.

That you are a threat to society.

Even

statements that suggest connections to extreme groups

could mean having your residence permit revoked.

This law has sparked some debate. Why do you think that is?

It could become arbitrary.

And if you already

If you have a residence permit, you should be able to rely on it.

and not risk losing it.

That is a fundamental principle in law.

The prohibition of retroactivity exists for example in tax law.

Or almost all areas we have, that there should be predictability.

You should know what applies.

In this case, the law will not express what is required of a person,

but it will be stated in the preparatory works.

There are no people who

have a residence permit and, as a newcomer to Sweden, sit and read government bills.

This becomes very unclear and uncertain.

We should have time to talk a little about the other so-called

duty to inform, which also comes into effect today.

This means that a number of authorities have an obligation to inform the police,

The Migration Agency, if they meet a person who they suspect is staying in Sweden

without a permit.

How big of a difference do you think this law will make?

There was a lot of criticism when they started talking about healthcare staff and

teachers being dragged into this and becoming informants, so to speak.

But that has been withdrawn, so the authorities that would ultimately

be subject to this system,

were the Public Employment Service and the Social Insurance Agency.

You know them yourself: the Prison and Probation Service, the Enforcement Authority,

the Pensions Agency and the Tax Agency.

Those are the authorities that

already exchange information among themselves.

I think it's sensitive that social services or

the Social Insurance Agency shares

information with other authorities,

the Prison and Probation Service and whatever it may be.

Many people think so.

As a result, individuals do not turn to the authorities, risking being caught.

It is primarily undocumented people that this is about.

Thank you very much for this, Mikael Kindbom,

for clarifying what applies to this news.
