Legal Challenges Faced by SJP Party

The coming times could be dangerous for the SJP party.

Either Deepak and company will save their lives by going to Boston,

USA, or they will have to answer here.

If not here, we will certainly put pressure on them in the courts.

Now, we will have individual cases filed by all the families of the police officers.

You may withdraw the case, but in my individual capacity, I have every right.

I am a citizen of this country and I have the right to go to court.

Every single drop of blood will be accounted for.

In our individual capacity, we have the right,

which was previously Section 156( 3),

and now there is a provision for it in the BNSS.

We can approach the court with our petition.

We can privately file a case against them in that, and even seek damages from them.

We can claim from them,

we can get compensation for the injuries caused to me.

Because of this, I couldn't go on duty for six months.

I should be awarded₹ 1 crore in damages from those who signed this.

Look, in the press release, we have tried to highlight all these things.

But since this is a very delicate matter,

the paper I have contains an undertaking.

Its title itself is' Undertaking by the Organizer for Jantar Mantar'.

Whenever anyone goes to Jantar Mantar, Ramlila Ground,

or the border to hold a demonstration, they have to give an undertaking.

But this undertaking is not a Delhi Police undertaking.

This is a direction from the Supreme Court of India, which is Writ Petition,

Criminal Writ Petition 1153/ 2017, There were guidelines from 2017,

based on which the Delhi Police formulated an SOP, 48/ 2022.

Under that, the organizer has to sign and submit all these details.

That I will adhere to all these things, accept them, and will have to obey the law.

Since there are 22 points, let me tell you the important ones.

The most important point among them is at number five, which states that... '

Organizer shall ensure that dharna demonstration will be in orderly manner.'

Orderly means it will be conducted in a proper, legal manner.

Apart from that,

the sixth point is that I will not allow a gathering of more than 1,000.

This responsibility lies with the organizer.

Apart from that, condition number nine is that this protest will only take place

between 10: 00 a.m. and 5: 00 p.m., which they violated from the very first day.

Apart from that, there is a rule that whatever banners or flags there are,

their length and width must be nine feet by six feet.

And flags, banners,

and sticks are purely for display, you can only use them to show,

like it was done to show the Delhi Police Federation. But you cannot misuse them.

You cannot write anything on them that hurts anyone's sentiments,

or proves anyone wrong, nor can you

write anything about a foreign country. Things like that.

Apart from that, there is another very important point,'

I and other organizers shall ensure', which applies to all organizers,

whether it was Deepke or any of his associates, '

shall ensure that no participant shall make provocative speeches'.

They will not make provocative speeches and' use language calculated or likely to

inflame passion of crowd or incite them'.

They cannot say anything that would incite the crowd.

The way he said' Let's march to Parliament' during the monsoon session on the 20th,

it was deemed provocative, as if he incited the people.

Because of which, they broke through the first, second, and third barricades,

and just 200 yards away from Parliament,

the police had to use full force to stop them,

resulting in heavy injuries to the police.

Our 128 officers and personnel were injured.

In addition to this, many things have been stated.

You will not do anything based on religion, race, place of birth, residence,

or language. But there was a 100% violation there.

All of these things happened there.

Apart from this, the most important thing,

which is the 21st point out of the 22 points, ' I shall be responsible to keep the

followers under control, failing which,

I along with others shall be prosecuted under the existing provisions of law.'

If I violate any provisions under the law, action should be taken against me.

They have given this in writing to the Delhi Police, which is in accordance with the

Supreme Court guidelines.

Now they must account for whether the organizer,

I, or the Delhi Police should be held responsible for the violations.

So, the coming times could be dangerous for the SJP party.

regarding what happened to their husbands and fathers.

Whether the government acts or not,

we have the right in our individual capacity.

What was earlier Section 156( 3) is now provided for in the BNSS.

We can approach the court with our petition and privately file a case against them.

Rather, we can seek damages from them.

We can file a claim, get compensation from them, saying," I was injured,

due to which I couldn't go to duty for six months.

I should be awarded a penalty of 10 million rupees from them," whoever has

signed this." So that's why I keep saying that their

troubles are going to increase significantly now.
