Teacher Fired Over Gender Identity Books

state of Oregon,

fired for refusing to put away books affirming traditional gender identities.

Out of L.A., William Lajeunesse runs down this story

and what have we learned. William, hello.

Hey Bill, you know the question now is how is

this ruling going to be applied around the country

given how politically correct some schools and teachers are?

So the case here was could a teacher display

a book whose title some found offensive?

The ninth circuit said no.

A school counselor did not have a First Amendment right

to feature these gender-themed books,

He is He, She is She, and Johnny is a Walrus

About a Boy Confused About His Gender Identity.

So here's what happened.

After a colleague complained,

the district said Rod Tice could keep the books in his office provided

children could not see or read them.

Only a single offended teacher criticized the religious viewpoints

of He is He and She is She and

later coordinated a setup to have Rod further disciplined.

The setup,

a hostile teacher sent in several eighth graders

into his office. He allowed them to read the books.

It was recorded and the video turned over to the district which terminated

the counselor. He appealed claiming a First Amendment right to display the materials.

Two to one, the court said no.

If it's during school hours and it's during instruction of children

or working with children, then the district can decide

what is being said and what's not being said.

Yes, correct, and then that's the bottom line.

Now the dissenting judge called out a double standard.

Other teachers hung pride flags,

Black Lives Matter posters, and displayed LGBTQ literature,

but no books on traditional gender identity.

Rod Tice was fired from his job, literally fired for expressing biological facts.

And when I say expressing, by displaying a book behind him,

he wasn't reading it to students, he wasn't compelling anybody to read them.

It was just the covers, apparently,

that were so offensive.

So the two judge favoring the district

were appointed by Presidents Obama and Biden.

The dissenting judge, dissenting opinion rather, Bill,

came from a judge appointed by President Trump.

Okay, all right, I'm glad you're on it, William.

Thank you.
