Public Recording Rights Discussion

Hi, how are you?

Hi, good.

How are you doing?

Good.

Could I ask you to stop, please?

Stop?

Yes, please.

Who are you?

I'm Leanne Ortega.

How are you?

Leanne Ortega?

Yes, how are you?

Nice to meet you.

And you are?

Oh, I would like to remain anonymous right now.

Okay.

Yeah.

So, what was going on?

You want me to stop recording?

Well, I'm just wondering, um, why are you recording?

And, yeah.

Oh, why I'm recording?

Yeah.

I'm just taking pictures in public, that's all.

Okay.

Yeah.

Um, are you here for your appointment, or how can we help?

I'm not on probation.

Oh, okay.

Yeah.

Um, so, I would not like to be recorded.

Well, you came up to me and started talking to me, right?

Yeah.

So, if you don't want to be recorded, don't come up and start a conversation with the

guy recording.

Okay.

I'm not sure if anybody here in our lobby would like to be recorded either.

And I've actually, I can record them, but I'm not going to.

I'm not going to record them because they're just here for probation.

I'm recording the public employees, which is you guys, that you're paid by tax dollars.

These individuals pay your salary, so I'm not going to record them.

It's not against the law for me to do that, but out of respect for them, I'm not going

to.

I'm asking you not to record me.

Okay.

Oh, you're asking me?

I am asking you not to record me, please.

All right.

Okay.

Can I ask you something?

Go right ahead.

Can I get five bucks?

Um, I can't pay you.

You can't pay me?

Okay.

So, I'm having to ask.

I can't stop recording.

So, I kind of have like this policy that anyone that I talk to that like asks me for random

things, you know what I mean?

That I just ask them for five bucks.

It's kind of like my little thing.

Okay.

So, um, I'm going to ask you to stop recording me.

If you're not here for an appointment, then, um, then, then what?

If you're here for an appointment, I'm going to have that.

I mean, this is open to the public.

I'm here for business, so.

Um, please call the security, please.

Yeah, I just, I came in here.

I wanted to check out your area.

I was going to grab one of these pamphlets for my viewers, you know, to see what stuff you guys offer.

I was noticing the corp care thing.

I thought that was really cool.

Yeah, I do.

I'm going to highlight that in my story.

That's wonderful.

But see, I'm just walking around in the public accessible areas.

I'm not going behind your area, right?

So, I mean, I have a constitutional right to do this.

Absolutely.

We can give you other pamphlets, too, if you'd like.

So, I do have a pamphlet.

We can provide you with other resources.

We can provide you with that, too.

If you'd like to get any other resources, we can help you with that.

So, you said absolutely.

So, I do have a constitutional right to come in here?

Well, no.

I'm saying if you want to get any other resources, we can provide you with that resources if you'd like.

Yeah, I would love to hear about the resources you have.

But you told me that you're going to ask me to stop recording.

And then when I said I'm not going to do that, you said you're going to get security over here.

I'm asking you not to record me.

But you're out here talking to me, ma'am.

So, if you don't want to be recorded, why don't you go back to your office?

Yeah.

Thank you.

And you shouldn't initiate force.

What you're doing is you're initiating violence, ma'am.

You're trying to get security to come up and use force and coercion to remove me out of here

when I'm engaged in a constitutionally protected activity, ma'am.

Hello.

Hi.

Hi.

This gentleman, I've asked him to stop recording me and others in our lobby.

And he's not here for an employment reason.

Yes.

He's in a public area.

And he has a right to be here.

Okay.

He's allowed to record.

I think we just talked a few minutes ago.

Oh, okay.

So, he's okay to just sit and record everybody?

It's a public space.

All right.

He doesn't have a key or a lock or a key card on it to restrict access.

I think he's aware of that.

Okay.

Sounds good.

Everybody else doing okay?

Yeah.

And everybody else.

So, he'll just ask other clients if they want to be recorded and that's everything.

Everything's okay?

Yeah.

It's a public area.

Sounds wonderful.

I just want to make sure we were okay to do that and get everything.

Okay.

We're all screwed.

Thank you so much.

Thank you.

Okay.

Thank you.

All right, thank you.

Is there anything else I can help you with, sir?

Yeah, so you got a little education then?

So you understand that?

I did, yeah.

I just want to make sure everything's okay.

Okay, appreciate that.

Yeah, any other resources I can help you with?

No, just as those, the pamphlet was the only thing.

Okay, court care.

Look at this, we got a whole bunch of them here, guys.

No, I was just making sure that we're okay,

and I just asked you to stop recording me.

That was it.

We just had heard an alarm,

so we just came to check it out.

Oh, there's an alarm back there?

Okay.

You guys pushed the alarm on me?

No, there's not on you, sir.

I think there's an alarm back there.

Sorry.

Right, yeah.

It's not related to me at all, huh?

I'm not sure, so.

Okay.

Thank you.

All right, ma'am.

I will look for a court care in English version for you,

and I can get that for you, okay?

Okay.

All right, thank you.

Have a nice day.

You too.

Oh, when you come back out there,

you said you were gonna get me your business card.

Yes, I will do that.

Yeah, thank you.

Thank you.

Thank you.

Thank you.

Thank you.

Thank you.

Thank you.

Hey.

Hey.

Here's my card.

Thank you so much.

Yeah.

So we're good then?

So I can come in here and record, right?

As far as I know, that's what the deputy said.

And I think just out of respect,

I asked you several times not to record me.

Exactly, and I understand,

they say people don't like to be recorded,

but you work for the public, right,

and you pay the tax dollars,

so we're able to hold our government accountable,

right, there's case law on that.

Blick v. Knife, it states that we're allowed

to record public officials in the course of their duties,

right, there's also Catsby U.S.,

which states there's no expectation of privacy in public.

If you don't want to be recorded,

really, the only way to get around that

is to work in the private sector.

So have a nice night, have a good weekend.

You too.

Thank you.
